Rape Charges in Kentucky

There are three legal degrees to rape:

  • Third Degree - sexual activity with an individual that is unable to consent due to lack of mental development, the victim is less than 18 years old, or the offender is in a position of authority.
  • Second Degree - sexual activity with an individual that is unable to consent due to lack of mental disability or the victim is less than 14 years old.
  • First Degree - sexual activity with an individual that is being forced against their will, an individual who is physically vulnerable, or the victim is less than 12 years old.

Rape comes with hefty felony penalties, including:

  • Third Degree - Class D felony, punishable by up to 5 years in prison
  • Second Degree - Class C felony, punishable by up to 10 years in prison
  • First Degree - Class B felony, punishable by up to 20 years in prison

Note - Rape involving a victim less than 12 years of age, or if the victim sustains a serious physical injury, the felony is automatically categorized as a class A felony which comes with 20+ years in prison if convicted.
