Kentucky law doesn’t use “child molestation” as a standalone statutory term. These charges are prosecuted under the sexual abuse statutes in KRS Chapter 510, and the severity depends on the age of the alleged victim, the age of the accused, the nature of the conduct, and any relationship of authority the accused held over the child.

Sexual contact is defined under KRS 510.010 as the touching of a person’s intimate parts, or the clothing covering that area, if the touching can be reasonably construed as done for the purpose of sexual arousal or gratification. The definition isn’t limited to sex organs and doesn’t require penetration.

Degrees of Charge & Sentencing Ranges

The three sexual abuse statutes that most commonly apply in child-related cases carry meaningfully different penalties:

• Sexual abuse in the first degree (KRS 510.110): Applies when the accused subjects a person under 12 to sexual contact, uses forcible compulsion, or when the accused is 21 or older and the alleged victim is under 16. Classified as a Class D felony (1 to 5 years) unless the victim is under 12, which can elevate the charge to a Class C felony (5 to 10 years).
• Sexual abuse in the second degree (KRS 510.120): Applies when the accused is between 18 and 21 and the alleged victim is under 16. A Class A misdemeanor carrying up to 12 months incarceration and a fine up to $500.
• Sexual abuse in the third degree (KRS 510.130): Applies when sexual contact occurs without consent. A Class B misdemeanor carrying up to 90 days incarceration and a fine up to $250.
