How Kentucky Law Charges Sexual Assault

Kentucky has no standalone “sexual assault” statute. Conduct that falls under that term is prosecuted as rape, sexual abuse, or sexual misconduct under KRS Chapter 510, and the specific charge depends on the circumstances: the nature of the contact, the alleged victim’s age, whether forcible compulsion is alleged, and the relationship between the parties.

Rape Under KRS Chapter 510

Rape is divided into three degrees. First-degree rape (KRS 510.040) involves sexual intercourse through forcible compulsion or with a victim incapable of consent and is a Class B felony. Second-degree rape (KRS 510.050) applies when the victim is under 14 and the offender is 18 or older and is a Class C felony. Third-degree rape (KRS 510.060) covers intercourse with a victim under 16 where the offender is 21 or older, a victim aged 16 or 17 where the offender is at least 10 years older, a victim under 18 where the offender serves as a foster parent and is 21 or older, or a victim under 18 where the offender holds a position of authority or special trust; it’s a Class D felony.

Sexual Abuse Under KRS Chapter 510

Sexual abuse charges turn on sexual contact rather than intercourse. First-degree sexual abuse involves contact through forcible compulsion or with someone incapable of consent and is a Class D felony, upgraded to Class C when the victim is under 12. Second-degree sexual abuse is a Class A misdemeanor; third-degree is a Class B misdemeanor. Sexual misconduct under KRS 510.140, a Class A misdemeanor, covers non-consensual intercourse not captured by other Chapter 510 provisions and is sometimes charged as a lesser-included offense.

Penalties for a Conviction in Kentucky

Prison ranges vary significantly by degree. First-degree rape carries 10 to 20 years as a Class B felony, increasing to 20 to 50 years or life if the victim is under 12 or suffers serious physical injury. Second-degree rape carries 5 to 10 years; third-degree carries 1 to 5 years. First-degree sexual abuse carries 1 to 5 years, or 5 to 10 years when upgraded to a Class C felony. Second-degree sexual abuse carries 90 days to 12 months; third-degree carries up to 90 days.

Prior felony convictions can trigger persistent felony offender status, extending any prison term beyond the base range. Under KRS 510.015, a third or subsequent misdemeanor Chapter 510 offense may be prosecuted as a Class D felony.

Beyond prison, a conviction for rape or sexual abuse triggers an automatic application for an interpersonal protective order under KRS 510.037. That order can last up to 10 years and is renewable in 10-year increments. Sex offender registration follows automatically: first-degree rape and certain offenses involving multiple felony counts against minor victims require lifetime registration; all other Chapter 510 convictions require 20-year registration. Registration restricts where you can live, work, and travel, and limits contact with children and victims.
